What is considered reckless driving in Tennessee?

My cousin just told me that they could go to jail for being charged with reckless driving. I don’t know what that means or if they were even in the wrong. What is considered reckless driving in Tennessee?

You’re right to be concerned about your cousin. Tennessee Code Title 55-20-205 considers reckless driving as driving “in willful or wanton disregard for the safety of persons or property.”
There’s room for law enforcement to make their own judgments, but the following behaviors are examples of reckless driving:
  • Swerving in and out of traffic
  • Drag racing
  • Passing on a two-lane highway with limited visibility
  • Popping a wheelie on a motorcycle in any area that is frequently accessible to the public
  • Driving into a flooded area marked with adequate signage or barricades
Your cousin may be able to fight the charges in some cases, but they’ll need to appear in court and they’ll probably want to hire a lawyer. Charges for reckless driving face fines, jail time, and add
six points to your driving record
, which will not fare well for their insurance rates.
