What is aggravated drunk driving?

Is there a difference between aggravated drunk driving and regular drunk driving? Is one of them just worse than the other? We’re learning about drunk driving in my driving class right now and I really don’t get why there are two types of DUIs.

An aggravated DUI is definitely worse than a regular DUI! Aggravated drunk driving differs from regular drunk driving due to aggravating influences present at the time of the arrest. These aggravating influences can include:
  • Driving with a revoked, restricted, or
    suspended license
  • Driving with a child under 15
  • Getting multiple DUI convictions within a certain period of time
  • Your BAC is significantly higher than the legal limit of 0.08%
  • Someone is injured or killed as a result of your actions
  • You don’t have proof of insurance
Aggravated DUIs are a felony, while most DUIs are charged as a misdemeanor. This means that the charge itself and the lasting consequences are both much more serious for an aggravated DUI than for a regular DUI.
