Is driving while suspended a felony?

Will I be charged with a felony if I’m caught driving with a suspended license? My suspension period is almost over and it would save me some money if I could start driving myself to work again but I don’t want to risk a felony on my record.

Unfortunately, it is possible that a driving while suspended charge could earn you a felony. The charge will depend on the state you live in and the severity of the offense.
Some factors that could up the charge to a felony include:
  • Causing an accident or bodily harm to another person
  • Having multiple offenses, particularly if your license was originally suspended due to a DUI
If you are charged with a felony for driving with a suspended license, you could face consequences including jail time, heavy fines, and license revocation. Even if you’re not charged with a felony, though, you’ll usually be charged with a misdemeanor, which could also come with jail time, heavy fines, or a lengthened license suspension.
