In some states, yes,
distracted driving
is a moving violation. This is because using your phone behind the wheel is dangerous for everyone around you, including pedestrians, other drivers, and any passengers in your own vehicle.
In some states, however, this offense is not considered to be a moving violation. California, for example, classifies distracted driving and cell phone usage as minor traffic infractions that don’t add points to your driving record. This is a less common approach to discouraging distracted driving, but it is the law in certain states.
