If the accident wasn't my fault, how come the other insurance company isn't paying to fix my Kia?

"I was involved in a not at-fault accident a few weeks ago. Both my insurance and the other driver's insurance sent me letters stating the other driver was at fault.

But now I have a letter from the other company saying they will not be making a payment on the claim and cannot disclose why. How is this possible? "

“This is such an unfortunate position to be in! There can be times when the other driver is at fault but their carrier can deny the claim.

The other driver might have had a lapse of coverage at the time of the accident. The other option is that the driver might have been involved in an illegal activity that caused the accident. If the car was being used to carry out a crime, the driver would not be covered for the accident.

Either way, if you do not have

collision coverage

as part of your policy, your only recourse is to sue the other driver directly in order to be reimbursed for the damage to your car.

If you have any medical expenses as a result of the accident, you may be covered under your

medical payments coverage

or

uninsured motorist coverage
