You can get a hardship license in California after receiving your first DUI if you are 21 or over, your license or driving privileges aren’t revoked for other reasons, and you took a chemical test when requested at the time of your DUI.
Along with these requirements, you can only get a hardship license in California for personal driving privileges. That means if your brother drives a car for commercial purposes (like truck driving), a hardship license won’t help.
