How can I get my car fixed after an accident with an uninsured driver in NY?
My car was hit in NY, a no-fault state, by an uninsured driver. My insurance agent said that my uninsured motorist coverage does not pay for my car, and I do not have collision coverage. How can I get the other person to pay for my car?

““No fault” is a term that is very confusing to drivers. It actually refers to personal injury protection, or PIP coverage, a type of
auto insurance
that pays for injuries to you or your passengers in an accident, regardless of fault. If you are not at fault for an accident, the other party is still liable for the damages to the vehicle.
In New York,
uninsured motorist coverage
is for bodily injury, not for property damage, so it wouldn’t have been applicable in your situation.If the other party in the accident is uninsured, the only way to recover damages from them would be to pursue them directly through the courts.
It is frustrating, but unfortunately, without
collision coverage
or the ability to file a claim through the other person’s insurance, there isn’t much that you can do.
