Do I have to take the towing company to small claims court over damage they caused?
"I had my car towed by AAA through one of their contractors. I thought it was a minor mechanical issue, but when I got to the repair shop, they said my front axle was broken.
There's no way this could've happened while I was driving. I would have noticed. Now the towing company is denying any wrongdoing.
Do I have to take them to small claims court?"

“You’re going to have a tough time proving that the towing company was at fault for this unless you took pictures of the underside of your car before the tow.
Chances are that you probably didn’t. As a result, you could take them to small claims court, but it’s unlikely that a judge will side with you without any proof.
If you have
towing and labor coverage
on your car insurance policy or even AAA
, make sure to take pictures of your car before the tow. That’s the only way you’ll be able to prove they did the damage.”View full answer
