. No California law requires you to take a sobriety test unless you’re under 21 or you’re on probation for another crime.However, you should take note between a sobriety test and a breathalyzer. If the officer requests, you can decline a breathalyzer, but it comes with consequences. Declining a breathalyzer test results in a mandatory one-year license suspension, as well as steeper penalties if you’re convicted of DUI after a blood or urine test.
Keep in mind that the liver breaks down 12 ounces of beer, a glass of wine, or a shot of liquor in one hour. If you can maintain this drinking pace or wait for an hour per drink, you shouldn’t have any issues. Never drive when you’re buzzed or have gone over this limit, and you shouldn’t have to worry about taking or refusing a sobriety test.
