Can you get a ticket in Virginia for aggressive driving?

Does the state of Virginia give out tickets for aggressive driving? I’m a little confused by the term because it seems really similar to reckless driving.

Reckless driving and aggressive driving are pretty similar, but aggressive driving involves the intent to frighten or harm another person. You can get a ticket for aggressive driving in Virginia. The charge is a class two misdemeanor, meaning you could face a fine of up to $1,000, jail time of up to six months, or both. Aggressive driving can include behaviors like:
  • Tailgating the person in front of you
  • Driving on the wrong side of the road
  • Disregarding lane markings
If you are charged with
aggressive driving with the intent to harm
another person, the charge is upped to a class one misdemeanor. In this case, you’ll be looking at up to a year in jail, up to a $2,500 fine, or both. If you’re charged with a class one misdemeanor, your best bet is to hire a lawyer who specializes in traffic court.
