Can you drink on a boat if you’re not driving it?
Some friends and I are getting ready to head to the lake to celebrate my birthday this weekend. I suggested we rent a boat, but as I was thinking more about it, I got to wondering if that was a good idea since we’ll be drinking. We’ll have a designated driver, but is it legal for the rest of us to drink since we’re not actually driving the boat?

As you obviously know, it is illegal to operate a boat while drinking or under the influence no matter where you are, but most states do not apply the same rules to the boat passengers. There are a few states with extra laws on the books regarding drinking-and-boating though, so be sure to check your state’s regulations before you pack your cooler.
You should also keep safety considerations in mind. Just because you’re not driving doesn’t mean you can’t still cause problems by drinking on a boat. Here are some risks associated with passengers drinking on a boat:
