What happens when the other driver is at fault, but their insurance company won't pay out?
I got into an accident and the police report confirms the other driver is 100% at fault. I filed a third-party claim against their liability policy. After weeks, the other person's company keeps avoiding me. What should I do?

“If the other driver’s insurance company keeps dodging you, that’s a problem. Most insurance companies will give you an idea of what’s going on or whether they’re still investigating the accident.
Since you have a police report confirming that the other driver was at fault, you’re in good shape. However, you may have to sue them to get compensation for property damage or medical bills.
You can also report the insurance company to your state’s Department of Insurance. They may be able to help you resolve this problem.
