“If you’re declared not at fault in an accident, your car insurance
company should cover any damages or injuries to the other party as long as you are properly insured. To determine fault, your insurance company has an adjuster look at the details of the accident, as well as the damage. This also determines whether your vehicle can be repaired or is deemed a total loss.
If your vehicle is deemed a total loss, your insurance company determines its actual cash value (original price minus depreciation) and pays out based on that. You can use this money to pay off your loan if you financed your car, or you can put it toward a down payment on a new vehicle.
The other thing you’ll want to do is make sure you have a record of the police report. It should include who was at fault in the accident. If you didn’t file a police report, you may want to consider doing so to provide additional proof if the other party’s insurance company denies fault.
