Is Wisconsin a no-fault state?
How does Wisconsin figure out who has to pay what after a car accident? I got into a fender bender recently and I’m a little worried that I’ll have to cover some of the damages myself.

Wisconsin is not a
no-fault state
. Rather, it’s what’s called a tort state, which means that fault will be assigned to one or more parties after an accident to determine who is responsible for paying for damages.Wisconsin also has comparative negligence laws in place. This means that your payout after the accident is partially determined by your percentage of fault.
- If you are deemed 20% at fault for an accident, you’ll only be able to recover 80% of the damages suffered
- If you’re more than 50% at fault, you won’t be able to recover damages at all
