Yes—unsafe driving is considered a moving violation in NJ. Moving violations are any violation of traffic laws that occur when the car is in motion.

First-time offenders will receive a fine ranging from $50 to $150. There is no point penalty for first-time offenders. A second unsafe driving violation will result in a fine of no less than $100 and no more than $250. Again, no points are added to your driving record. A third or subsequent unsafe driving violation comes with a fine between $200 and $500 and four points added to your driving record.
