Is Kentucky a no-fault state?

My sister was in a car accident last week that she caused. Is Kentucky a no-fault state or will she have to pay for the other driver’s damages?

So sorry to hear your sister was involved in a collision. Kentucky is a no-fault state, but this doesn’t mean that no blame is assigned in a collision. Let’s dig into the details:
  • In an at-fault state, also called a tort state, the driver who causes the accident is liable for paying for the other driver’s damages incurred.
  • In a no-fault state, drivers will go to their respective insurers for compensation for medical expenses resulting from an accident. However, the responsible driver is usually still required to pay for the other driver’s property damage.
Kentucky is one of 12 no-fault states. Here are the others:
  • Florida
  • Hawaii
  • Kansas
  • Massachusetts
  • Michigan
  • Minnesota
  • New Jersey
  • New York
  • North Dakota
  • Pennsylvania
  • Utah
In your sister’s case, her insurer is likely responsible for paying for the other driver’s damages incurred in the accident. Depending on the amount of coverage your sister has, her damages may not be covered. If she would like greater protection in the future, she may consider purchasing

.
An at-fault accident will likely cause your sister’s
