Is Illinois an at-fault state?

My friend was in a car accident last week that he caused. Is Illinois an at-fault state or will the other driver’s insurance pay for the damages?

So sorry to hear your friend was involved in a collision. Illinois is an at-fault state, which means that if a driver is found more than 50% at fault for causing an accident, they are responsible for compensating the other party for damages. Let’s discuss that in greater detail:
  • In an at-fault state, also called a tort state, the driver who causes the accident is responsible for paying the other party for damages incurred.
  • In a no-fault state, both parties will go to their respective insurers for medical expenses resulting from an accident. However, the responsible party is typically still required to compensate the other party for their property damage.
At-fault states include:
  • California
  • Illinois
  • North Carolina
  • South Carolina
  • Texas
No-fault states include:
  • Florida
  • Hawaii
  • Kentucky
  • Massachusetts
  • New York
In your friend’s case, their insurance provider will likely pay for damages incurred to the other driver’s vehicle in the accident. His damages may not be covered. If your friend would like greater protection in the future, he may consider purchasing
full coverage insurance
.
An at-fault accident will cause your friend’s
