Is driving without a seatbelt a misdemeanor?

What is the charge for driving without a seatbelt? Sometimes my mom drives without putting on her seatbelt first and I’m really nervous about getting pulled over and getting in trouble.

Driving without a seatbelt is considered a misdemeanor in all states except
New Hampshire
. This means you’ll usually be charged a fine if you’re caught without your seatbelt on.
However, not all states have a primary enforcement policy when it comes to seatbelt laws. If you live in a state with primary enforcement laws, that means that you can get pulled over for neglecting to wear a seatbelt.
If your state has secondary enforcement laws, however, you have to be pulled over for something else (like speeding) before the officer can issue a ticket for not wearing a seatbelt. To learn more about seatbelt laws in your state, read your state laws about the issue.
