How much money can I get for my medical bills if the other driver was at fault in an accident in South Dakota?
I was rear-ended in an accident in South Dakota. Since that time, I've undergone MRIs and have five bulging discs in my back. This might cost tens of thousands of dollars or more in surgery and physical therapy. The other driver's insurance company offered $25,000, but this isn't nearly enough.

Since the insurer only offered $25,000, it sounds like the other driver only had the state-minimum level of
liability insurance
. If that’s the case, then $25,000 is all that the other driver’s insurance company is required to offer. However, South Dakota also requires drivers to carry
uninsured/underinsured motorist coverage
, with a bodily injury liability limit of $25,000 per person. Assuming you have underinsured motorist coverage, your medical expenses should be picked up by your own insurance where the at-fault driver’s liability car insurance leaves off.If you’re uninsured, then you’ll have to pay your remaining medical bills yourself or sue the other driver to get more money.
