How long will a DUI stay on my driving record in New York?

I stupidly tried to drive back from Chippewa after clubbing one night and now I’m officially convicted with my first DUI. I’m worried this will limit me from crossing the border for a long time. How long will I have a DUI on my New York driving record?

stays on your driving record between ten and fifteen years. The length of time will depend on which drunk driving offense you were convicted with.
Here’s how New York breaks it down:
  • DWAI (driving while alcohol impaired)—your BAC was between .05 and .07, the conviction stays on your driving record ten years
  • DWI (driving while intoxicated)—your BAC was .08 or over, the conviction stays on your driving record fifteen years
That said, having either conviction on your driving record will make entering Canada extremely tricky, if not impossible. Canada takes both DWI and DWAI charges very seriously. Here are your options:
  • You can sometimes apply for a Temporary Resident Permit (TRP) that will allow limited entry with valid reason
  • You can apply for Criminal Rehabilitation (CR) which will forgive your conviction—but you can only apply for this five years after your conviction
Unfortunately, the Canadian border can deny you entry even if the DUI/DWI/DWAI is no longer on your driving record. Each entry into Canada is handled on a case-by-case basis, so you can be denied entry for your DUI at any time.
