It’s understandable to feel frustrated about a traffic ticket you think was unjustified. To get out of a texting and driving ticket, here’s what to do:
- Plead not guilty to the infraction, which may require a trip to the courthouse, depending on your jurisdiction.
- Schedule a trial date if one has not already been assigned by the court clerk.
- Consult an attorney if you have the funds, but be aware this may cost more than paying the ticket
- Gather evidence of your innocence for trial, such as a phone record or a witness who can attest that you weren’t texting and driving.
- Go to court on your hearing date.
- Meet with the prosecutor, who may offer to reduce the charge if you are willing to plead guilty. They may also drop the charges if they find your evidence to be compelling.
- Make your case to the judge.
- If the judge does not rule in your favor, ask about your appeal options.
