Can I wear headphones while driving?

The speakers in my car crackle whenever I listen to the radio, so I usually put in my headphones while I’m driving. My friend told me that it was illegal, but I’ve never had any run-ins with the law. Is it legal to wear headphones while driving?

Somewhat surprisingly, driving with headphones is legal in 32 states and Washington, D.C. However, it’s illegal in nine states, including:
  1. Alaska
  2. California
  3. Louisiana
  4. Maryland
  5. Minnesota
  6. Ohio
  7. Rhode Island
  8. Virginia
  9. Washington state
The remaining nine states have certain restrictions based on the vehicle and whether or not you have one or two earbuds in. Regardless of whether or not wearing headphones is legal, it’s not always the best option.
Headphones can lead to
distracted driving
